GENERAL TERMS AND CONDITIONS
1. SCOPE OF APPLICATION / CONTRACT LANGUAGE
These terms and conditions (GTC) apply to the contracts concluded between you and us, the Schule für Schauspiel Hamburg GbR (Oelkersallee 29a, 22769 Hamburg) via this website.
The language available for the conclusion of the contract is exclusively German.
2. SUBJECT MATTER OF THE CONTRACT / REGISTRATION AND NUMBER OF PARTICIPANTS
The subject matter of the contract consists of courses, workshops, trainings, orientation courses, short seminars, coachings, advanced trainings, etc. (hereinafter also referred to as "events" in their entirety) offered on our website.
The details, in particular the essential characteristics of the respective events, the dates, costs and contract periods can be found in the respective description on the web pages available at www.sfsh.de.
The presentation of the events on the websites available at www.sfsh.de, does not constitute a binding offer on our part. Instead, it invites the participant to submit a binding registration online. Therefore, a contract for participation in the respective events does not come into effect with the receipt of your registration. A contract is only concluded when the registration has been confirmed by us by email.
The number of participants in the orientation course, the short seminar and the advanced training course is limited. Registrations will be considered in the order in which they are received. In case of overbooking, the registrant will be informed immediately; in this case, no contract will be concluded. The courses take place in groups. If the required minimum number of 8 participants per orientation course, short seminar or advanced training course is not reached, the Schule für Schauspiel Hamburg GbR reserves the right to cancel the course. Participants* will be notified by the 3rd day before the course.
The courses will take place presently at the Schule für Schauspiel Hamburg GbR. If this is not possible for reasons beyond the control of Schule für Schauspiel Hamburg GbR (e.g. a pandemic), we reserve the right to hold the classes online instead.
The Schule für Schauspiel Hamburg GbR is not obligated to make up for missed classes or classes cancelled by the participant.
3. CANCELLATION / POSTPONEMENT
We reserve the right to cancel an event
- for organizational reasons up to the 3rd day before the event date;
- for important reasons for which the Schule für Schauspiel Hamburg GbR is not responsible (e.g. illness/accident of the trainer) up to and including the date of the event;
- due to force majeure and if legal restrictions prevent the event from taking place due to a pandemic, up to and including the date of the event;
to cancel or postpone the event.
In the event of a postponement of the event, no refund will be made. Alternate dates will be announced in due time.
The participant has no right to a specific trainer. The Schule für Schauspiel Hamburg GbR is entitled to appoint a substitute trainer, who is equally qualified, for important reasons, deviating from the event program.
In case of a complete cancellation by the Schule für Schauspiel Hamburg GbR, the full price will be refunded if payment has already been received. Any further liability and compensation claims, which do not concern the injury of life, body or health, are excluded, as far as there is no intent or gross negligence on our part. This also applies to futile expenses (e.g. hotel rooms booked by you, travel expenses such as air or rail tickets, as well as expenses incurred due to loss of work, etc.). In all other respects, the provisions of the section "Liability" under para. 7 apply.
4. RESERVATION OF RIGHT TO CHANGE
The Schule für Schauspiel Hamburg GbR is entitled to make minor changes to the content and organization (e.g. time frame, breaks, etc.) of the event program before or during the event, provided that this does not significantly affect the benefit of the event.
5. ARRIVAL / OVERNIGHT STAY / HOTEL
Travel and overnight accommodation are not included in the price.
6. PRICES / PAYMENT
The price stated at the time of booking is decisive. Unless otherwise stated, the price includes participation in the event.
The event/lesson/course fee is to be transferred to the account of the Schule für Schauspiel Hamburg at the latest 10 working days before the event/lesson/course begins.

The Schule für Schauspiel Hamburg GbR shall be liable for damages within the scope of the statutory provisions only in accordance with the following provisions.
The Schule für Schauspiel Hamburg GbR shall be liable for damages resulting from injury to life, body or health as well as for damages caused by intent or gross negligence on the part of Schule für Schauspiel Hamburg GbR or its legal representatives or vicarious agents, as well as for damages in the event of non-compliance with a guarantee given by the Schule für Schauspiel Hamburg GbR or due to fraudulently concealed defects.
The Schule für Schauspiel Hamburg GbR shall be liable, limited to compensation for the foreseeable damage typical of the contract, for such damage that is based on a slightly negligent breach of essential contractual obligations by it or its legal representatives or vicarious agents. Material contractual obligations are obligations the fulfillment of which is essential for the proper performance of the contract and on the fulfillment of which the contractual partner may regularly rely.
Other claims for damages of the participants are excluded. The provisions of the Product Liability Act shall remain unaffected.
The limitations of the above provisions shall also apply in favor of the legal representatives and vicarious agents of the Schauspiel Hamburg GbR, if claims are asserted directly against them.
Beyond the legal regulations, the participant can withdraw from the contract under the following conditions:
Withdrawal from the contract is only possible in the case of the orientation courses, short seminars or the advanced training courses (hereinafter also referred to as "courses" in their entirety). The withdrawal from the contract must be made in text form (e.g. e-mail, fax). In order to meet the deadline, the declaration of withdrawal must be received by the Schule für Schauspiel Hamburg GbR in text form. For courses lasting several days, the first day of the course is decisive for the deadline.
Consequences of withdrawal
- If notification of withdrawal is declared no later than the 7th day before the course date, the price will be reduced to 50%.
- In case of later withdrawal, the full price will be charged. The same applies in case of non-appearance on the first day of the course. If the Schule für Schauspiel Hamburg GbR succeeds in filling the cancelled place elsewhere, it must take into account the advantage gained thereby.
We are entitled to refuse a refund until you have returned any seminar materials you have already received or until you have provided proof that you have returned these seminar materials, whichever is earlier.
Please note that in the event of a cancellation, you must also cancel the hotel accommodation(s), train tickets, airline tickets, etc. that you have booked yourself.
9. DATA PROTECTION
The personal data associated with the registration will be processed and stored in compliance with data protection regulations.
10. CANCELLATION POLICY
Right of withdrawal
Consumers are entitled to a right of revocation according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity:
You have the right to revoke this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Schule für Schauspiel Hamburg GbR, Oelkersallee 29a, 22769 Hamburg, Germany, Tel.: 040/ 4302050, e-mail: email@example.com) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

Reasons for exclusion/cancellation of the right of cancellation
Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), unless otherwise agreed, a right of revocation does not apply to contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision.
The right of withdrawal shall expire in accordance with Section 356 (4) of the German Civil Code (BGB) in the case of contracts for the provision of services if
- we have provided the service in full
- and have started the performance of the service only after you have given your express consent to start the performance of the service and at the same time confirmed your knowledge that you lose your right of withdrawal upon complete performance of the contract by us.

12. GENERAL DUTY OF INFORMATION according to § 36 VSBG (German Disputes Resolution Act)
We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
13. SEVERABILITY CLAUSE
Should a provision be or become invalid or should gaps requiring supplementation become apparent during the execution of the contract, this shall not affect the validity of the remainder of this agreement. The parties then undertake to immediately reinterpret, supplement or replace the invalid provision or to fill the gap in such a way that the purpose of the contract intended by the invalid provision or jeopardized by the gap is achieved.
